Hutchison in funding dispute with CIRtel on H3G Italia

Hutchison Whampoa is in a funding dispute with its Italian joint venture partner CIRtel as to whether CIRtel is in breach of its funding obligations under the H3G Italia shareholders' agreement in demanding the repayment of a Euro373.2million shareholder loan from CIRtel to the venture unit H3G Italia.

Hutchison is the majority shareholder with 88.2% stake in H3G Italia is currently in settlement proceedings pending before the International Chamber of Commerce for the resolution of the dispute.

Under the joint venture agreement, CIRtel which has a 1.8% in the venture is required to provide funding to H3G Italia. A ruling is expected in late 2003.

The case is the second brought by Hutchison against a 3G partner as it shares the cost of building a 3G network. Two months ago, Hutchison sued Royal KPN, the largest Dutch phone company, over £150 million that KPN refused to lend to their UK venture.
