3 successfully appeals SMP designation

Hutchison 3G UK ("3") welcomed the ruling by the Competition Appeal Tribunal ("CAT").
The CAT handed down its decision in the case between 3 and the Office of Communications ("OFCOM"). The decision annuls the significant market power ("SMP") designation made by OFCOM against 3 in June 2004.
The decision is significant as it is the first occasion in the UK that a telecoms operator has successfully appealed against an SMP designation by the national regulatory authority.
Bob Fuller, 3 UK CEO said: "We welcome today's ruling and will review the full text of the decision in due course. This result will not affect 3's great value price plans and allows 3 to move on and concentrate on delivering the best communications, entertainment and information to our customers on the move."
